A special meeting of the Council for the City of Crystal Falls was held in the Council Chamber of the City Hall on Thursday, April 22, 2004 at 4:30 p. m. Central Time.

Present: Mayor Sabo, Councilors Hendrickson, Thrasher, and Koszyk.

Absent: Councilor Benda

Also present were City Manager Nordeman, Attorney Lawrence, City Clerk/Treasurer Olson, Bill Leonoff, and two Forest Park students.

The purpose of this special meeting was to conduct a Public Hearing and take action on Ordinance No. 1.09 authorizing the City of Crystal Falls to lease or authorize the lease of any lands of the city.

Mayor Sabo opened the Public Hearing on Ordinance No. 1.09 and read the following ordinance to all present:

ORDINANCE NO. 1.09

 

AUTHORITY TO LEASE REAL PROPERTY

 

An Ordinance to authorize the City of Crystal Falls to lease or authorize the lease of any lands of the city as required by Section 2.11 (7) of the City Charter.

THE CITY OF CRYSTAL FALLS ORDAINS:

Section 1.0

 

The City of Crystal Falls, by a majority vote of the City Council, shall have the authority to lease or authorize the lease of any lands of the city as required by Section 2.11(7) of the Charter for the City of Crystal Falls, Michigan as approved by the voters on May 5, 1998.

 

This Ordinance shall take effect and be in full force at the expiration of thirty (30) days after adoption.

 

Mayor Sabo called for public comment on Ordinance No. 1.09. There was none.

Mayor Sabo called for Council comment on Ordinance No. 1.09.

A discussion ensued regarding the need for the ordinance to authorize the City to do what they are already authorized to do by state statutes. Attorney Lawrence noted that the City Charter mandates the ordinance. It was also stated that because this is an enabling ordinance there was no need for penalties and fines to be attached. It was suggested to combine those ordinances required by the charter and adopt them at one time. Clerk Olson noted that Section 2.12(a) of the City Charter requires that no ordinance shall contain more than one subject, which shall be clearly expressed in its title.

Mayor Sabo closed the Public Hearing at 4:50 p.m.

Councilor Thrasher seconded by Councilor Hendrickson moved to adopt Ordinance No. 1.09 – An Ordinance to authorize the City of Crystal Falls to lease or authorize the lease of any lands of the City as required by Section 2.11(7) of the City Charter.

Ayes: Councilors Thrasher, Koszyk, and Hendrickson, and Mayor Sabo.

Nays: None

Motion carried.

There being no further business on the agenda for this special meeting of the City Council, the meeting adjourned at 4:57 p.m.
