A special meeting of the Council for the City of Crystal Falls was held in the Council Chamber of the City Hall on Monday, May 24, 2004 at 4:30 p. m. Central Time. Present: Mayor Hendrickson, Councilors Thrasher, Benda, and Koszyk. Absent: None Also present were City Manager Nordeman, Attorney Lawrence, City Clerk/Treasurer Olson, and a contingent of citizens. The purpose of this special meeting was to conduct interviews with the applicants and appoint a replacement for the vacancy on the City Council, and conduct a public hearing on proposed Ordinance No. 1.10, authorizing the City of Crystal Falls to convey or authorize the conveyance of any lands of the city. Mayor Hendrickson led all present in the Pledge of Allegiance. The Council applicants included William McCarthy, Donald Boulanger, and Mark Valesano. Each applicant was asked to respond to a series of questions developed by the Council in order to assist in the appointment of a replacement for the Council vacancy. Councilor Benda seconded by Councilor Thrasher moved to appoint Mark Valesano to serve on the City Council until the November 2, 2004 General Election. Ayes: Councilor Thrasher, Benda, Koszyk, and Mayor Hendrickson Nays: None Motion Carried. Clerk Olson administered the Oath of Office to appointee Mark Valesano who then took his seat at the Council table. Mayor Hendrickson temporarily adjourned the meeting to conduct the scheduled Public Hearing on proposed Ordinance No. 1.10. Meeting temporarily adjourned at 4:42 p.m. Public Hearing opened at 4:42 p.m. Mayor Hendrickson read the proposed Ordinance No. 1.10, an ordinance to authorize the City of Crystal Falls to convey or authorize the conveyance of any lands of the city as required by Section 2.11(7) of the City Charter, and then called for comments from the public. Joseph D. Sabo of 412 Briar Hill Street approached the podium and read a prepared statement regarding the proposed ordinance. He noted that the proposed ordinance does not define the process nor distinguish between public and private sales, which are usually different and should, therefore, require separate ordinances. He also noted that the proposed ordinance does not protect the public interest nor meet the intended requirements of the City Charter. Mayor Hendrickson asked Attorney Lawrence if the proposed Ordinance No. 1.10 met the requirements of the City Charter to which Mr. Lawrence advised that it did and the Council could add specifics to it in the future if desired. There were no more public comments regarding the ordinance. There were no Council comments regarding the ordinance. The Public Hearing was closed at 4:46 p.m. Meeting reconvened at 4:46 p.m. Councilor Koszyk seconded by Councilor Benda moved to adopt Ordinance No. 1.10 as follows: ORDINANCE NO. 1.10
AUTHORITY TO CONVEY REAL PROPERTY ORDINANCE
An Ordinance to authorize the City of Crystal Falls to convey or authorize the conveyance of any lands of the city as required by Section 2.11 (7) of the City Charter. THE CITY OF CRYSTAL FALLS ORDAINS: Section 1.0 The City of Crystal Falls, by a majority vote of the City Council, shall have the authority to convey or authorize the conveyance of any lands of the city as required by Section 2.11(7) of the Charter for the City of Crystal Falls, Michigan as approved by the voters on May 5, 1998. This Ordinance shall take effect and be in full force at the expiration of thirty (30) days after adoption.
Ayes: Mayor Hendrickson, Councilors Benda, Koszyk, and Thrasher Nays: None Abstain: Councilor Valesano Motion carried. Councilor Koszyk seconded by Councilor Benda moved to adjourn this special meeting of the City Council at 4:47 p.m.
