A special meeting of the Council for the City of Crystal Falls was held in the Council Chamber of the City Hall on Friday, October 29, 2004 at 9:00 a.m. Central Time. Present: Mayor Hendrickson, Councilors Thrasher, Koszyk, and Valesano. Absent: Councilor Benda Also present were City Manager Nordeman, City Attorney Lawrence, and City Clerk/Treasurer Olson. The purpose of this special meeting was to introduce an ordinance to regulate the installation and use of outdoor furnaces designed to for structure heat. Mayor Hendrickson led everyone in reciting the Pledge of Allegiance. Mayor Hendrickson suggested the proposed ordinance be read aloud by the Council to assist in the review. Councilor Thrasher suggested including a clause about the need to be compliant with all applicable state and federal laws when installing and using an outdoor furnace. This will be added to Section 3, Regulations in the 7th paragraph as item C. A discussion ensued regarding the chimney requirement and the setback of 200’ from the nearest property line of another property owner. The Council felt this was extremely restrictive and noted that the chimney should be above the rooflines of structures in the neighborhood to get the smoke up away from ground level. The end result was the re-write of the first paragraph of Section 3 to read "Outdoor furnaces shall not be placed less than forty (40’) feet from the nearest point of intersection of any other structure and shall have a chimney stack of at least twenty (20’) feet and/or at least two (2’) feet above the roof line of the highest structure within two hundred (200’) feet." Also, the next paragraph was changed to read "Outdoor furnaces shall not be placed less than ten (10’) feet from the nearest point of intersection of the property line of another property owner." Consideration was given to restricting the months of operation of an outdoor furnace but it was decided to let that issue go for now. Councilor Koszyk seconded by Councilor Valesano moved to set the Public Hearing for consideration of Ordinance No. 2.22 to be Monday, November 8, 2004 during the regular meeting of the City Council at 4:30 p.m. Motion carried. Councilor Koszyk seconded by Councilor Thrasher moved to adjourn this special meeting of the City Council. Motion carried. Meeting adjourned at 10:05 a.m.
