ORDINANCE NO. 1.04

AN ORDINANCE TO CREATE AND ESTABLISH A DOWNTOWN DEVELOPMENT AUTHORITY.

WHEREAS, the City council for the City of Crystal Falls having deemed necessary for the best interest of the public and in order to reduce property value deterioration and increase property tax valuation in its business district and to promote economic growth, has declared its intention to create and provide for a Downtown Development Authority, and;

WHEREAS, pursuant to said Resolution, the said Council did set the 9th day of April, 1979, at 6:30 p.m., CST, at the Council Chambers in the City Hall as a place for the holding of a public hearing on the adoption of the proposed Ordinance creating the authority and designating the boundaries of the downtown district, and;

WHEREAS, public notice of said hearing was provided by publication in the Diamond Drill, a newspaper of general circulation within the municipality as prescribed by law and other notice having been given as provided by law;

NOW, THEREFORE, THE CITY OF CRYSTAL FALLS ORDAINS:

There is hereby established a Downtown Development Authority pursuant to Public Act 197 of the Public Acts of 1975 as amended with the said boundaries of the downtown district established as follows:

Commencing at a point of beginning 900 ft. West of the NW corner NE-NE, Sec. 20, T43N, R32W, a point also to be known as 150 ft. (M/L) from the W. shoreline of Paint River; thence SE along a line (150 ft. from said shoreline) paralleling said shoreline to a point 200 ft. S. of the N. line of Gov’t lot 8, Sec. 28, T43N R32W; thence E. to said shoreline; thence SE’ly along said shoreline to the S. line of Superior Avenue. R/W; thence W. 150 ft. (M/L) along said line; thence SSE’ly along center line of present utility easement containing forced sewer main to the S. line of Gov’t lot 8, Sec. 28, T43N R32W; thence W. to the NE corner of the NW – SW, Sec. 28, T43N R32 W; thence S. 1320 ft. (M/L) along said E. ¼ line to the SE corner of NW/SW, Sec. 28, T43N R32W; thence W. 1320 ft. (M/L) to the W. line of Sec. 28, T43N R32W; thence N. 1453 ft (M/L) along said W. sec. Line to the S. R/W line of Michigan Ave.; thence E. along said S. R/W line 60 ft; thence N. 130 ft. to S. line of alley between Superior Ave. & Marquette Ave.; thence E. along said line to NE corner of Lot 19 (J.B. Schwartz Add.); thence S. along the E. line to SE corner of said lot; thence W. to the SW corner (River St.); thence N. along said line to the S. line of said alley between Superior Ave. and Marquette Ave.; thence W. to the W. line of Second St.; thence SE along said line to the S. line (R/W) of Marquette Ave.; thence W. along said R/W line to the E. R/W line of Sixth St.; thence N. along said R/W line to an easterly extension of the N. lot line common to Lots 7-12 of the Crandall’s Add.; thence W. to the N-S City limits (center line of Seventh St.); thence N. along said City limit line to the N. line of Crystal Ave.; thence E. along N. R/W line to the E. R/W line of Sixth St.; thence N. along said R/W line to the S. R/W line of Spring Ave.; thence E. along said R/W line to the E. R/W line of 5th St.; thence N. along said R/W line to the N. R/W line of Erie Ave.; thence E’ly along an easterly extension of said N. Erie Ave R/W line to the NW corner of a parcel (101,102, 104, NE-NE of Sec 29, T43N R32W) formerly known as C & NW RR R/W; thence NE 300 ft to the NE corner of said parcel of land; thence SE 216 ft (M/L) to the W. line of the NW-NW Sec. 28 T43N R32W (also, E. line of Sec. 29, T43N R32W); thence N. 442 ft. (M/L) along said section line to the NW corner of Sec. 28, T43N R32W; thence East along said N. line of NW-NW Sec. 28, T43N R32W to P.O.B.

Amended to include Government Lots 4 and 5, Section 20 T43N R32W; the NE ¼ of the SE ¼ of Section 20, T43N R32W; and the NE ¼ of the NE ¼ and the NW ¼ of the NE ¼ of Section 29 lying East of Fifth Street Extended.

Further amended to conform aforementioned description to the map.

This Ordinance shall take immediate effect to provide for the usual daily operation of the City as outlined in Sec. 8.3b of the City Charter; further, this a compilation and renumbered version of ordinances previously adopted.

THE FOREGOING ORDINANCE WAS AMENDED ON 04/10/00 AS FOLLOWS:

ORDINANCE AMENDING
ORDINANCE NO. 1.04

Ordinance Number 1.04 was adopted by the City Council of the City of Crystal Falls, State of Michigan, on April 27, 1979;

An amendment to the ordinance is necessary and in the best interests of the citizens of the City of Crystal Falls in order to define the extension of the legal descriptions of the boundaries of the Downtown Development Authority to include the Crystal Falls Industrial Park property.

NOW THEREFORE, THE CITY OF CRYSTAL FALLS HEREBY ORDAINS:

Ordinance Number 1.04 is hereby amended with the following legal description addition:

 

All that part of the NW ¼ of the NE ¼, Section 30, T43N, R32W, more particularly described as follows: Commencing at the Northeast corner of said NW ¼ of the NE ¼; thence South along the East line of said NW ¼ of the NE ¼ to the Westerly line of the abandoned Chicago, Milwaukee, St. Paul Railway Company right-of-way; thence Southerly along said abandoned right-of-way line to a point being 233 feet north of the South line of said NW ¼ of the NE ¼; thence West 150.0 feet, more or less, to the Northwest corner of the parcel of land described in Liber 107 of Deeds, pages 60-61; thence South 33 feet; thence West 100 feet, more or less, to the Northwest corner of the parcel of land described in Liber 165 of Deeds, page 466; thence South 167 feet, more or less, to the North right-of-way line of U. S. Highway No. 2; thence Westerly along said Northerly right-of-way of U. S. Highway No. 2, a distance of 100 feet, more or less, to a point being 383.7 feet West and 33 feet North of the Southeast corner of said NW ¼ of the NE ¼; thence North 150 feet; thence West 893.3 feet, more or less, to the Northeasterly right-of-way of U. S. Highway No. 2; thence Northwest along said right-of-way line to the West line of said NW ¼ of the NE ¼; thence North along said West line to a point being 100 feet South of the North Section line; thence East 233 feet; thence North 100 feet to the North section line; thence East along the North section line 1,087 feet, more or less, to the point of beginning. EXCEPT all that part conveyed to the Michigan State Highway Commission for the relocation of Highway U.S. 141, more particularly described in Liber 161 of Deeds, pages 404 through 407

EFFECTIVE DATE

This amended ordinance shall become effective in the City of Crystal Falls following the adoption by the City Council and upon publication.
