ORDINANCE NO. 1.10 AUTHORITY TO CONVEY REAL PROPERTY ORDINANCE An Ordinance to authorize the City of Crystal Falls to convey or authorize the conveyance of any lands of the city as required by Section 2.11 (7) of the City Charter. THE CITY OF CRYSTAL FALLS ORDAINS: Section 1.0 The City of Crystal Falls, by a majority vote of the City Council, shall have the authority to convey or authorize the conveyance of any lands of the city as required by Section 2.11(7) of the Charter for the City of Crystal Falls, Michigan as approved by the voters on May 5, 1998. This Ordinance shall take effect and be in full force at the expiration of thirty (30) days after adoption. Introduced: May 10, 2004
CITY OF CRYSTAL FALLS AMENDMENT TO ORDINANCE NO. 1.10 The following procedures shall be followed when conveying real property under this ordinance: Great Western Subdivision Plat No. 1 & 2 Lots: Should a perspective Buyer make a valid offer, in writing, for the purchase of any lot in the Industrial Park that is lower than the appraised value the City Council shall have the option of accepting the offer but only after a Public Hearing is held to allow the citizens of Crystal Falls an opportunity to be heard on the proposed sale. All other real property owned by the City of Crystal Falls: b) If the City Council decides to sell a parcel of land a bid
advertisement shall be prepared for publication in a locally published
newspaper for solicitation of sealed written sale bids with the
appraised value stated as a minimum bid. The Notice shall include a
description of the real property for sale; the property’s street
address (if applicable); location where sealed bids shall be
delivered; date and time the bidding will close and date and time bids
will be opened and announced. c) The successful bidder will have 60 days to make payment in full for the real property and in the event the successful bidder is unable to make payment in full within this time the offer to purchase is null and void and City may place the real property up for sale under this ordinance or not as it sees fit. d) In the event that the City receives a bid lower than the
appraised value the City Council shall have the option of accepting
the bid or offer and conveying the property at a price lower than the
appraised value but only after a Public Hearing is held to allow the
citizens of Crystal Falls and opportunity to be heard on the proposed
sale. Prior to approval of the exchange the City shall hold a Public Hearing to allow the citizens of Crystal Falls an opportunity to be heard on the proposed exchange. Ordinance Adopted: December 12, 2005 Ordinance Published: December 21, 2005 Ordinance Effective: January 11, 2006
