ORDINANCE NO. 3.02 AN ORDINANCE TO REGULATE PARKING ON THE PUBLIC HIGHWAYS WITHIN THE CITY OF CRYSTAL FALLS, MICHIGAN, TO PROVIDE FOR THE ARREST AND PENALTIES TO BE IMPOSED UPON PERSON VIOLATING THE PROVISIONS OF THIS ORDINANCE. THE CITY OF CRYSTAL FALLS ORDAINS: Section 1 No person shall stop, stand, or park any vehicle on any street, highway, or any alley except as permitted by the terms and conditions of this ordinance, whether such stopping, standing, or parking be temporary for the purpose to taking on or discharging passengers, or for a period of time, except if person is directed by Police Officer, sign, or signal, or emergency breakage to do otherwise. Section 2 When signs are erected on streets regulating parking, no person shall park any vehicle in violation of such sign. Any vehicle parked in violation of any signs, conditions or requirements of this ordinance is declared a nuisance, which may be abated by said City or cited by said City, or agent(s) as hereinafter provided. Section 3 All vehicles shall be parked parallel with curb, with both front and rear right-hand wheels within six (6) inches of the curb, or edge of roadway, except where angle parking is permitted, then front wheel shall be against curb, except funerals and officers discretion, and right side of said vehicle shall be at angle designated by appropriate signs. Commercial or other vehicles greater in length than twenty-two (22) feet, shall not be permitted to park on streets where angle parking is permitted. Section 4 No person driving, or in charge of a motor vehicle, shall permit it to be parked, unattended, without first effectively setting the brakes, stopping the engine, and locking the ignition, to prevent its starting and operation by any unauthorized person. Section 5 Daytime parking Superior Avenue: No person shall, between the hours of 9:00 a.m. and 6:00 p.m. of each day stand or park a motor vehicle for a longer period than two hours on Superior Avenue from First Street to Fifth Street, and/or on Third Street from its intersection with Superior Avenue to respective alleys North and South, and/or Fourth Street from its intersection with Superior Avenue to the respective alleys North and South. No person shall stand or park a motor vehicle at any time on the North or South side of Superior Avenue from Fifth Street to Sixth Street, except as may be authorized by City Council or while in attendance at a regularly scheduled church service or governmental function. Section 6 Overnight Parking No person shall between the hours of 2:00 a.m. and 7:00 a.m. of any day stand or park a motor vehicle on either the North or South side of Superior Avenue. This regulation shall apply to all public streets and/or alleys of said City during the period intervening between November 1st and May 1st of any year. Section 7 School Parking No person shall stop, stand, or park any vehicle on the West side of 8th Street between Marquette Avenue and Michigan Avenue; on the North side of Marquette Avenue between 7th Street and 8th Street; on the West side of 7th Street between Marquette Avenue and Forest Parkway; on the West side of High Street between Forest Parkway and the alley directly North thereof; and, on the East side of Iron Street and Maple Street between Forest Parkway and the alleyway directly North thereof. No person shall stop, stand, or park any vehicle during regular school hours on the following streets: South side of Forest Parkway from Ski Hill Road to 7th Street except that section from Ski Hill Road to a point midway between Maple & Iron Streets that is signed for a 15 minute "Drop Off Zone". West or East side of Iron Street between Forest Parkway and Crystal Avenue
(US2) as signed. West or East side of Maple Street between Forest Parkway and Crystal Avenue (US2) as signed. No person shall stop, stand or park any vehicle for a period of time to exceed 15 minutes on the North side of Forest Parkway from High Street to Maple Street during regular school hours except that area immediately East of Maple that is signed as "No Parking School Hours". Visitor parking only will be permitted on the South side of the private bus driveway on the North side of the Forest Park School, except during the hours of 8:00 a.m. to 8:30 a.m., and 2:45 p.m. to 3:15 p.m., when no standing or parking will be allowed. Section 8 Restricted Zones A person shall not stop, stand, or park a vehicle in any of the following places, except when necessary to avoid conflict with other traffic or to comply with the law or the directions of a police officer: On a sidewalk. In front of a public or private driveway. Within 15 feet of a fire hydrant. In front of any theatre, immediately before, during or after performance. In a parking space which is clearly identified by an official sign as being reserved for use by handicappers and which is on public property or private property that is available for public use, unless the person is a handicapper or is parking a vehicle for the benefit of a handicapper. At any place where official signs prohibit stopping, standing, or parking. Section 9 Enforcement Any police officer of the City of Crystal Falls who shall witness a violation of any of the provisions of this Ordinance relative to the parking of motor vehicles on public streets shall give violator a written notice directing person to appear at the Crystal Falls Police Department within seven (7) days after receipt of such notice. Section 10 Parking Violation Notice If any vehicle be parked on any public street or alley in said City, in violation of provisions of this Ordinance, the notice as provided above shall be affixed by the Officer witnessing the violation, to some part of said vehicle, in such manner as to give the operator or owner of such vehicle the same notice that would be given were the notice served upon them personally. The notice provided shall further state the nature of the violation, where it occurred, and what date and time. Section 11 Penalty A sum of $10.00 shall be charged for any violation(s) regarding stopping, standing, or parking provisions of this Ordinance by motor vehicles on streets of said City. This Ordinance shall take immediate effect to provide for the usual daily operation of the City as outlined in Section 2.12 of the City Charter; further, this is merely a compilation and renumbering of ordinances previously adopted.
