UTILITY BILL PAYMENT OPTIONS

ORDINANCE NO. 2.11

AN ORDINANCE TO REQUIRE PERMITS AND TAP-ON FEES FOR CONNECTION TO PUBLIC UTILITIES SERVED BY THE CITY OF CRYSTAL FALLS

THE CITY OF CRYSTAL FALLS ORDAINS:

Section 1

This ordinance shall be known and cited as "Public Utilities Permit Ordinance".

Section 2 Purpose

The purpose of this ordinance is to provide for the most expedient and economic use of existing public utility facilities and to prevent the overtaxing of existing facilities to the detriment of present and future residents of the City of Crystal Falls.

Section 3 Permit Requirements

From and after the 1st day of March, 1977, any person, firm or corporation desiring to connect to any sewer, water, or electric transmission line owned and/or operated by the City of Crystal Falls, or to any sewer or water line which is serviced through the water waste disposal system or filtration plant owned by the City of Crystal Falls shall first obtain a permit from the City Clerk, and deposit a permit fee to the fund of said City for which the permit has been granted.

Section 4 Tap – on Fees

Before any permit shall be granted by the said City Clerk, a tap-on fee as shall be determined and established by the City Council shall be paid to the City Clerk and deposited to the fund of said City for which the permit has been granted.

Section 5 Saving Clause

The provisions of this ordinance are hereby declared to be severable and if any clause, sentence, work, section or provision is declared void or unenforceable for any reason by any Court of competent jurisdiction, it shall not affect any portion of the ordinance other than that said part or portion thereof.

Section 6 Penalty

Any person, firm, or corporation who violates any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and shall be punished by a fine of not more than $100., or by imprisonment in the County Jail not to exceed ninety (90) days, or by both such fine and imprisonment. Each day that a violation continues to exist shall constitute a separate offense. In addition to the imposition of the foregoing fines and penalties, the City Manager or other city employee as the Manager shall designate, shall immediately, upon the discovery of a violation of this ordinance disconnect and sever any connection made in violation of this ordinance.

Section 7 Effective Date

This ordinance shall take immediate effect to provide for the usual daily operation of the City as outlined in Sec. 8.3b of the City Charter; further, this is merely a renumbering of an ordinance previously adopted.
